These Terms and Conditions (“Terms”) govern your use of the Larimar Pay website, mobile application, and related services (together, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
- “Larimar Pay”, “we”, “us”, “our” means DS Fleming Investments Ltd (No. 16702029), trading as Larimar Pay.
- “Regulated Partner” means RemitJunction Limited (No.07836487) or any other regulated payment service provider acting as the licensed principal.
- “User”, “you”, “your” means any individual or business using the Service.
- “Recipient” means the person or entity receiving funds or bill payments.
- “Transaction” means any money transfer, bill payment, top-up, or related service initiated via Larimar Pay.
2. Nature of the Service
Larimar Pay provides a digital platform that enables Users to initiate cross-border money transfers and related payment services.
Larimar Pay is not a bank, electronic money institution, or payment institution.
All regulated payment services are provided by our Regulated Partner, which:
- Is authorised and regulated by the Financial Conduct Authority (FCA) or relevant EU authority
- Performs customer due diligence (KYC)
- Safeguards customer funds
- Executes Transactions
Larimar Pay acts as a commercial agent, technology provider, and customer interface.
3. Eligibility
To use the Service, you must:
- Be at least 18 years old
- Have legal capacity to enter into a binding agreement
- Use the Service only for lawful purposes
- Not be subject to sanctions or financial restrictions
We may refuse or suspend access at our discretion.
4. Account Registration & Verification
You must provide accurate and complete information during registration.
You agree to:
- Complete identity verification (KYC)
- Update your information if it changes
- Keep login credentials secure
We may suspend or terminate accounts that:
- Provide false or misleading information
- Fail verification checks
- Are suspected of fraud or misuse
5. Transactions & Instructions
When you submit a Transaction:
- You authorise the Regulated Partner to process it
- Transactions are generally irreversible once executed
- Exchange rates and fees are disclosed before confirmation
You are responsible for ensuring:
- Recipient details are correct
- Amounts and references are accurate
Larimar Pay is not responsible for errors caused by incorrect information provided by you.
6. Fees & Exchange Rates
Fees may include:
- A fixed transaction fee
- Foreign exchange (FX) margin
- Third-party costs (e.g. payment method fees)
All fees and rates are shown before confirmation.
Larimar Pay may update fees from time to time with notice.
7. Bill Payments & Additional Services
Where available, bill payments or top-ups are executed via third-party partners.
We do not guarantee:
- Availability of all billers
- Real-time confirmation
- Acceptance of all references
Refunds for bill payments may be limited or unavailable once processed.
8. Prohibited Use
You must not use the Service for:
- Money laundering or terrorist financing
- Fraud, scams, or deception
- Illegal goods or services
- Circumventing sanctions or regulations
- Acting on behalf of undisclosed third parties
We may report suspicious activity to regulators and law enforcement.
9. Suspensions & Termination
We may suspend or terminate your account if:
- Required by law or regulation
- Requested by the Regulated Partner
- You breach these Terms
- We suspect unlawful activity
You remain liable for outstanding obligations.
10. Refunds & Complaints
Refunds are subject to:
- Payment status
- Partner rules
- Applicable law

If unresolved, complaints may be escalated to the Regulated Partner and, where applicable, the Financial Ombudsman Service.
11. Data Protection & Privacy
Your personal data is processed in accordance with:
- UK GDPR
- Our Privacy Policy
The Regulated Partner acts as Data Controller for regulated activities.
Larimar Pay acts as:
- Data processor and/or
- Independent controller for marketing and service improvement
12. Intellectual Property
All content, branding, and software are owned by or licensed to Larimar Pay.
You may not:
- Copy
- Reverse engineer
- Reuse without permission
13. Limitation of Liability
To the maximum extent permitted by law:
- Larimar Pay is not liable for indirect or consequential losses
- We are not responsible for third-party failures
- Our liability is limited to amounts permitted under applicable law
Nothing limits liability for fraud or statutory rights.
14. Indemnity
You agree to indemnify Larimar Pay against losses arising from:
- Breach of these Terms
- Misuse of the Service
- Violation of laws or third-party rights
15. Changes to Terms
We may update these Terms from time to time.
Material changes will be communicated via:
- Website
- App
- Email (where appropriate)
Continued use constitutes acceptance.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
Courts of England and Wales have exclusive jurisdiction, subject to consumer protection laws.
